Scope and Object of the General Terms


These General Terms are intended to regulate the terms and conditions under which the service ("Service") will be provided by Butterfly Valley Lda, with corporate identification number 514824719, hereinafter referred to as Butterfly Valley.
The Service consists of providing, through the Condominus mobile application, published on Google Play and the AppStore ("App"), a set of services that allow the App user (individually "User" and collectively "Users") to use the App for the management of their condominium.
The Service includes paid annual plans or the purchase of a lifetime license by the User in accordance with the current pricing published on the condominus.app website. Failure to make the respective payment will result in Butterfly Valley Lda reserving the right to limit the User's access to the App and the Service.
Registration in the App, for individuals, must be carried out by users aged 18 (eighteen) years or older (individuals under this age must have authorization from their representatives).
The elements and information provided by the User will have full legal effect, and the User cannot claim the lack of a signature as a reason for non-compliance with the assumed obligations.

Product Information and Content


Butterfly Valley will make every effort to ensure that the information presented does not contain typographical errors, and any such errors will be promptly corrected whenever they occur.
All information regarding prices, specifications, promotional actions, and services may be changed at any time by Butterfly Valley.


Responsibilities


The App has adequate security levels; however, Butterfly Valley will not be responsible for any damages suffered by the User and/or third parties due to delays, interruptions, errors, and suspensions of communications caused by factors beyond its control, including any deficiencies or failures caused by the communications network or communication services provided by third parties, the computer system, modems, connection software, or potential computer viruses or resulting from downloading ("download") through the service of infected files or files containing viruses or other properties that may affect the User's equipment. If, for any reason, access to the App is impossible and the Service cannot be provided, Butterfly Valley will not be responsible for any resulting damages.
Data and information queries carried out within the scope of this Service are presumed to be carried out by the User, and Butterfly Valley declines any responsibility arising from the abusive or fraudulent use of the information obtained.
Butterfly Valley will not be responsible for any losses or damages caused by abusive uses of the Service that are not directly attributable to it due to willful misconduct or gross negligence.
Butterfly Valley is not responsible for damages or losses resulting from non-compliance or defective compliance with the Service when such is not directly or indirectly attributable to it due to willful misconduct or gross negligence, and it is not responsible, in particular, for (i) errors, omissions, or other inaccuracies in the information provided through the Service; (ii) damages caused by the fault of the User or third parties, including violations of intellectual property, (iii) non-compliance or defective compliance resulting from compliance with judicial or administrative decisions, or (iv) non-compliance or defective compliance resulting from force majeure, i.e., extraordinary or unforeseeable situations outside Butterfly Valley's control, such as fires, power outages, explosions, wars, riots, civil uprisings, government decisions, strikes, earthquakes, floods, or other natural disasters or other situations beyond Butterfly Valley's control that prevent or hinder the fulfillment of the assumed obligations.
Butterfly Valley does not guarantee that:
i) the Service will be provided uninterruptedly, securely, without errors, or will function indefinitely;
ii) the quality of any service or information obtained through the Service will meet any expectations of the User;
iii) any material obtained in any way through the use of the Service is used at the User's own risk, and the User is solely responsible for any damage caused to their computer system and equipment or for any data loss resulting from such use.
iv) no advice or information, whether oral or written, obtained by the User from or through the Service will create any warranty not expressly stated in these General Terms.

The User accepts that Butterfly Valley cannot in any way be held liable for any damages, including but not limited to damages for loss of profits, data, content, or any other losses (even if the User has been previously informed of the possibility of such damages), resulting from:
i) the use or inability to use the Service;
ii) unauthorized access to or modification of personal databases.


User Obligations


The User agrees to:
i) Provide accurate personal data;
ii) Not use false identities;
If any of the data is incorrect or insufficient, and as a result, there is a delay or impossibility in processing the publication of information related to the service provided by the User or their schedule, the responsibility lies with the User, and Butterfly Valley declines any responsibility. In the event that the User violates any of these obligations, Butterfly Valley reserves the right to delete or block access to the App, cancel the provision of any other services provided simultaneously by Butterfly Valley to the same User, and, furthermore, not allow the User future access to any or all services provided by Butterfly Valley.
The User may not offer the following services:
- Services that promote offensive material (e.g., hate speech, incitement to violence against others, etc.).
- Financial services, money or credit processing; financial intermediaries or instruments equivalent to money; travel services (e.g., vacation packages); telephone services (e.g., prepaid phone services); and business marketing services.
- Services of a sexual nature.
- Services involving weapons, weapon replicas, and weapon accessories.


Intellectual Property


The App is a registered mobile application, and the Service is the responsibility of Butterfly Valley.
The User acknowledges that the Service contains confidential information and is protected by copyright and related rights, industrial property rights, and other applicable legislation.
The User acknowledges that any content included in advertising, highlights, promotions, or mentions of any sponsor or advertiser is protected by copyright and related rights laws, industrial property laws, and other property protection laws, and any use of such content may only occur under the express authorization of the respective rights holders.
The User agrees to fully respect the rights referred to in the previous paragraph, in particular by refraining from any acts that may violate the law or the aforementioned rights, such as reproduction, commercialization, transmission, or making available to the public of such content or any other unauthorized acts related to the same content.


Service Security Conditions


The User agrees to comply with all applicable legal provisions, in particular, not to engage in or encourage the practice of illegal acts or acts offensive to public morals, such as the indiscriminate sending of unsolicited communications (spamming) in violation of the applicable legislation on the processing of personal data and advertising communications through automatic calling devices, and must also comply with the rules of use of the Service, under penalty of Butterfly Valley suspending or deactivating the Service as provided in point 14.
The User expressly acknowledges and accepts that the IP Network constitutes a public electronic communications network subject to use by multiple users and, as such, subject to computer overloads, and therefore Butterfly Valley does not guarantee the provision of the Service without interruptions, loss of information, or delays.
Butterfly Valley also does not guarantee the provision of the Service in situations of unpredictable overload of the systems on which it is supported or in cases of force majeure (extraordinary or unforeseeable situations outside Butterfly Valley's control).
In the event of an interruption in the provision of the Service due to unpredictable overload of the systems on which it is supported, Butterfly Valley undertakes to restore its operation as soon as possible.


Suspension and Deactivation of the Service


Regardless of any prior or subsequent communication, Butterfly Valley may, at any time and at its sole discretion, discontinue the provision of the Service or part of it to one or all Users.
Butterfly Valley also reserves the right to suspend or immediately terminate access to the Service in the following cases:
a) When the User does not comply with the conditions of use referred to in point 4 and others mentioned in the General Terms;
b) When Butterfly Valley ceases access to the App, with prior notice 15 days before the date of cessation.
The suspension or termination of the Service by Butterfly Valley, under the terms of the previous paragraphs, does not entitle the User or third parties to any compensation or other indemnity, and Butterfly Valley cannot be held liable or burdened in any way for any consequences resulting from the suspension, cancellation, or termination of the Service.
In the situations described above, Butterfly Valley will notify the User in advance so that they can, if they wish, safeguard the content of their booking area, as well as their professional schedule, within 3 (three) working days from the sending of the email or the availability of the information on the Service's main page.


Communications


Without prejudice to other forms of communication provided for in these General Terms, notifications to the User related to the Service, including any changes to these General Terms, may be made to the User's email address, by SMS, or phone contact.
The User agrees to receive all communications and/or notifications related to the App at the address, contact phone number, and/or email address ("email") indicated during the registration process or, if changed later, on their profile page.
At any time, the User may request not to receive these communications and/or notifications through the Contact Form or through the "Do not receive the Newsletter" option included in each Newsletter.


Technical Settings


Without prejudice to the provisions of the following paragraph, Butterfly Valley may change the Service and/or the technical conditions of its provision, as well as the respective rules of use, and must inform the User of such changes with a minimum notice of 15 (fifteen) days.

Communications


Whenever Butterfly Valley deems it necessary or convenient to optimize the browsing experience and/or improve connectivity conditions, it may remotely reformulate the network settings.
Without prejudice to the provisions of the following paragraphs, and considering the innovative nature of the Service and the technological developments to which it may be subject, Butterfly Valley may change the technical settings of the Service whenever it deems it convenient to adapt it to potential technological developments.
However, Butterfly Valley does not guarantee the User any upgrades or improvements to the Service.
Some upgrades or new features of the Service may only be available upon payment by the User and/or the User's subscription to Specific Terms of Use.


Complaints


The User may submit any contractual conflicts to the arbitration and mediation mechanisms that are or may be legally established, as well as file complaints with Butterfly Valley regarding acts and omissions that violate the legal provisions applicable to the acquisition of goods.
The complaint must be submitted within a maximum period of 30 (thirty) days from the User's knowledge of the facts, and it will be recorded in Butterfly Valley's information systems, which must decide on the complaint and notify the interested party within a maximum period of 30 (thirty) days from the date of receipt.


Applicable Law


The Contract is governed by Portuguese law.
